Welcome to Cupmoney. By using this application, you agree to these terms. Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using the Cupmoney mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Cupmoney is a personal financial planning application that provides the following functionality:

• Expense tracking and analysis – manual entry and categorization of expenses
• Bank statement analysis – upload and AI-powered analysis of bank statements
• Payment data management – tracking payments, receipts, and transaction history
• Receipt scanning – optical character recognition (OCR) for receipt data extraction
• Financial insights – spending analytics, trends, and budgeting recommendations
• Educational content – articles and resources about personal finance

3. Privacy and Data Protection

3.1. Data Storage on Your Device

All of your financial data, including but not limited to:

• Bank statements
• Payment records
• Receipts and transaction details
• Spending categories and budgets
• Personal financial goals

Your data is stored primarily on your device. If you enable shared/family payments, selected payment records are also uploaded to our backend to synchronize with connected users.

3.2. Server Communication for AI Analysis

When you use AI-powered features (such as bank statement analysis, receipt recognition, or spending insights), your data is temporarily transmitted to our secure servers for processing.

Important guarantees:

• No permanent storage for AI-only analysis: Data sent for statement/receipt AI processing is not stored after processing is complete
• Processing only: Server communication occurs only to perform AI analysis and return results to your device
• Encryption: All data transmitted between your device and our servers is encrypted using industry-standard protocols (TLS/SSL)
• No sharing: Your financial data is never sold, rented, or shared with third parties
• No profiling: We do not use your data to build advertising profiles or for marketing purposes

3.3. Data You Provide

You are solely responsible for the accuracy and legality of the data you input into the App. By using Cupmoney, you confirm that:

• You have the right to upload and process all financial documents you provide
• You are not violating any third-party rights or agreements (e.g., bank terms of service)
• The data you provide does not contain information about other individuals without their consent

3.4. Minimal Data Collection

We may collect non-personal, anonymized analytics data to improve the App, including:

• Device type and operating system version
• App usage statistics (e.g., feature usage frequency)
• Crash reports and error logs (containing no financial data)

This data cannot be used to identify you personally and does not contain any financial information.

3.5. Shared Payments and Backend Synchronization

If you enable shared/family payments, selected payment records (for example: amount, currency, category, date/time, and optional notes) are uploaded to our backend to provide synchronization and collaboration with connected users.

• Encryption in transit: Shared payment data is encrypted during transmission using TLS/SSL
• Feature-limited use: This data is processed and stored only to provide shared payments functionality
• No sale to third parties: We do not sell shared payment data and do not use it for advertising

4. User Responsibilities

4.1. Account Security

You are responsible for:

• Maintaining the security of your device
• Using strong passcodes, biometric locks, or other device security features
• Not sharing your device with unauthorized users
• Immediately reporting any suspected security breach

4.2. Acceptable Use

You agree to use Cupmoney only for lawful purposes. You may not:

• Use the App to process data you do not have permission to access
• Reverse engineer, decompile, or attempt to extract source code from the App
• Use the App to violate any applicable laws or regulations
• Attempt to circumvent security measures or access unauthorized features
• Use automated systems or bots to interact with the App

5. AI and Machine Learning Features

Cupmoney uses artificial intelligence and machine learning to analyze financial data. You acknowledge that:

• AI analysis may not always be 100% accurate
• You should review and verify all AI-generated insights and categorizations
• The App's AI models may improve over time based on aggregated, anonymized usage patterns
• AI-generated recommendations are not guarantees of financial outcomes

6. Paid Subscription and Access

Starting with version 2.0, the Cupmoney App is distributed on a paid basis. Three paid access levels are available: monthly subscription, annual subscription, and lifetime access.

The subscription or lifetime access price may vary depending on your region, currency, taxes, and app store rules. The current price is shown in the App or app store before purchase.

Paid access applies to AI-powered functionality, including bank statement and certificate analysis, receipt analysis, voice input, email analysis, as well as family payments functionality.

Not having a paid subscription or lifetime access does not affect your ability to use the App's free functionality.

If you download the App through the Apple App Store, your use of the App is also governed by Apple's standard End User License Agreement (EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Auto-renewable subscriptions purchased through the App Store are managed by Apple and your Apple ID.

7. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Cupmoney or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. Disclaimers and Limitations of Liability

8.1. No Warranty

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or completeness of AI analysis

8.2. Limitation of Liability

To the maximum extent permitted by law, Cupmoney and its developers shall not be liable for:

• Any direct, indirect, incidental, special, or consequential damages
• Loss of data, profits, or business opportunities
• Damages resulting from your use or inability to use the App
• Decisions made based on information or analysis provided by the App
• Unauthorized access to your device or data due to your security practices

9. Data Retention and Deletion

You can delete all your data at any time by:

• Uninstalling the App from your device (removes all locally stored data)
• Using in-app data deletion features if available

If shared/family payments are enabled, part of your payment data may be stored on our servers for synchronization with connected users. Deleting the App removes local data from your device, but previously synchronized shared records may remain for connected participants.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will:

• Update the "Last updated" date at the top of this document
• Notify you through the App or via other reasonable means
• Give you an opportunity to review the changes before they take effect

Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

11. Termination

We reserve the right to:

• Suspend or terminate your access to the App for violations of these Terms
• Discontinue the App or any features at any time without prior notice
• Modify or replace features as needed for security or legal compliance

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through:

• Good-faith negotiation between you and Cupmoney
• If negotiation fails, through binding arbitration or small claims court
